Ambil Milik - Tarikh Borang K atau Tarikh Serah atau Tarikh Endorsan

Sehingga sekarang masih menjadi pertikaian mengenai TARIKH AMBIL MILIK sama ada TARIKH  BORANG K DITANDATANGANI ATAU TARIKH BORANG K DI SERAHKAN ATAUPUN TARIKH ENDORSAN BORANG K TERSEBUT. Ini penting kerana ianya melibatkan pengiraan Late Payment Charges di bawah seksyen 32(1), (1B), (1C), 2 dan seksyen 48. Juga isu penarikan balik dari pengambilan dibawah seksyen 35(1) Akta Pengambilan Tanah.

PANDANGAN

Berdasarkan seksyen  22 (1) Akta Pengambilan Tanah 1960:

'The Land Administrator shall take formal possession (ambil milik secara rasmi/sah) of any schedules land by serving upon the occupier thereof or, if he cannot be found, by posting thereon, anotice in Form K'

Perenggan 22.1 Manual Pengambilan Tanah:

Makna mengambil milik tanah atau taking possession of land ialah apabila notis Borang K dikeluarkan dan dihantar oleh Pentadbir Tanah kepada penduduk atas tanah itu atau jika penduduk tidak dapat ditemui, dengan menampalkan Borang K di atas tanah berkenaan. Fahaman yang mengatakan bahawa mengambil milik tanah atau taking possession of land hanya akan bermula mulai dari tarikh Borang K itu dibuat memorial atau endorsan di dalam dokumen hakmilik daftar ADALAH TIDAK BETUL DAN SALAH.

Berdasarkan penghakiman kes Koriah bt Sudar v Pentadbir Tanah Kuala Langat [2013] 3 MLJ 695, YA Hakim Azahar Mohamed, YA Hakim Lim Yee Lan dan YA Hakim Zawawi Salleh JJCA memutuskan:

[24]  We accordingly ordered that interest at 8%pa be paid on the sum of RM43,610, being the additional compensation awarded by the learned JC, from 5 October 2000 (date of the issuance of 'Borang K') to 11 July 2012 (the date of the sum RM43,610 credited into the appellant's solicitors client's account)

Keputusan di atas dibuat berdasarkan seksyen 48 Akta:

Wee agreed with the submission. Section 48 of the Act provides as follows:


If the sum which in the opinion of the Court the Land Administrator ought to have awarded as compensation is in excess of the sum which the Land Administrator did award as compensation, the award of the Court may direct that the Land Administrator Land Acquisition 43 shall pay late payment charges on such excess at the rate of eight per cent per annum from the date on which the Land Administrator took possession of the land to the date of payment of such excess to the Court or to the person interested. 

Berdasarkan penghakiman kes Ishmael Lim Abdullah v Persuruhjaya Tanah Persekutuan & Anor [2014] 7 CLJ 882 pula, YA Hakim Raus Sharif PCA, YA Hakim Abdul Malik Ishak JCA dan YA Hakim Mah Weng Kwai JCA memutuskan:

[39] We are of the view that upon the issuance of Borang K on 11 Mac 1974, the land had vasted in the State Authority ..................................................................................................

BERDASARKAN BUKTI-BUKTI DI ATAS SAYA BERPENDAPAT TARIKH AMBIL MILIK TANAH ADALAH BERMULA DARI TARIKH BORANG K DI SERAHKAN KEPADA ORANG YANG BERKEPENTINGAN
